Client:
A consumer, i.e. a natural person who, when concluding and fulfilling a consumer contract, does not act within the scope of their business activity, employment, or profession. Purchases made by a business entity are governed by the Commercial Code No. 513/1991 Coll.
The supervisory authority for consumer protection is the SOI Inspectorate for the Prešov Region, Obrancov mieru 6, 080 01 Prešov 1.
2. Nature of the Service
The subject of the contract is the provision of a service – a personal consultation (personal development advisory focused on resolving personal issues and restoring inner balance), delivered via remote electronic means (Signal, telephone). The standard duration of a consultation is 50 minutes.
The Client acknowledges that results achieved depend on their own activity and approach.
The Client further acknowledges that the Provider is not a healthcare provider and does not offer medical care, psychological diagnosis, counselling, or psychotherapy provided by qualified professionals.
3. Order and Payment
These GTC constitute the contractual relationship between the Provider and the Client.
Order process:
- The Client expresses interest in the service (personal consultation) via email, the contact form on the website, or a message on LinkedIn/Substack.
- A short free 10-minute introductory call is then held so the Client can determine whether the consultation is suitable for them.
- Upon mutual agreement, the Provider sends the Client a confirmation email or message with the date and time of the personal consultation.
- The contract is concluded at the moment the Client replies with a confirmation email or message expressing consent to these GTC and completes payment.
The price of the service is 50 EUR per consultation. The price is final; the Provider is not a VAT payer. In the event of the Client’s adverse financial situation, the Provider may grant a discount at their own discretion. The Client has no legal entitlement to a discount.
Payment may be made:
- by another method upon mutual agreement.
- in advance by bank transfer
4. Cancellation and Rescheduling Policy
The Client may cancel or reschedule an appointment at the latest 24 hours in advance.
For cancellations made less than 24 hours before the scheduled time, a fee of up to 75% of the service price (37.50 EUR) may be charged.
In the event of a no-show, the Client is not entitled to a refund of the paid amount or any part thereof.
If the appointment is cancelled by the Provider (illness, force majeure), the Provider will offer the Client an alternative date or a full refund of the paid amount.
5. Right of Withdrawal
The Client has the right to withdraw from a distance contract without stating a reason within 14 days of its conclusion – in accordance with § 19 of Act No. 108/2024 Coll.
How to withdraw: The Client sends the Provider an email to janaluk@protonmail.com with the following text: “I withdraw from the contract concluded on [date]. [Client’s name/alias].” A sample withdrawal form is included at the end of these GTC.
Important notice regarding withdrawal: If the service (personal consultation) is delivered before the expiry of the 14-day withdrawal period, the Client thereby expressly consents to the commencement of performance before the period expires and acknowledges that their right of withdrawal is thereby extinguished.
6. Liability
The Provider undertakes to deliver the service (personal consultation) with professional care and within the agreed scope. If the Client believes that the service provided had a defect (e.g. the consultation did not take place at the agreed time or for the agreed duration; there was a poor communication connection on the Provider’s side; or other external noise on the Provider’s side, such as construction works nearby, that affected the quality of communication), they shall inform the Provider without undue delay. The Client should not continue using a service on which they have identified a defect.
A defect may be claimed by the Client via email to janaluk@protonmail.com, without undue delay, including after the service has been provided.
Within 30 days of receipt of the complaint, and typically within 5 days, the Provider will acknowledge receipt and propose a resolution – such as a replacement consultation or a partial or full refund.
The Client bears full responsibility for their own decisions and actions during and after the consultation. The Provider is not liable for specific outcomes or for subsequent decisions made by the Client.
The following shall not be considered valid grounds for a complaint:
a) how much better or worse the Client felt after the service was provided;
b) that the Client did not learn something they did not previously know;
c) that the Provider agreed or disagreed with the Client’s opinions or the opinions of others.
The Provider likewise reserves the right to terminate the provision of the service (personal consultation) early, without the Client being entitled to a refund, in the event of inappropriate projection or the attribution by the Client of a relationship other than one founded on a professional basis for the purpose of providing the service.
7. Personal Data Protection and Confidentiality
Personal data is processed exclusively for the purpose of communication and service delivery, to the following extent: name (or alias), email address, and the content of the message sent by the Client. Processing is carried out in accordance with the GDPR (EU Regulation 2016/679) and Act No. 18/2018 Coll. on the protection of personal data.
The Client has the right to access, rectify, or erase their data.
The provision of the service (personal consultation) is confidential. The Provider and the Client are mutually bound by confidentiality regarding the content of their communication during the provision of the service. The Client likewise respects the confidentiality of the communication and shall not publish direct quotations from the consultation. Confidentiality does not apply to the presentation of opinions or feedback by the Client regarding the service provided.
8. Final Provisions
If the Client is dissatisfied with the service, they may contact the Provider at janaluk@protonmail.com. The Provider will respond within 5 working days and will endeavour to find a solution.
If the dispute is not resolved directly between the Client and the Provider, the Client as a consumer has the right to:
- Use the online alternative dispute resolution (ODR) platform: https://ec.europa.eu/consumers/odr
- Contact the Slovak Trade Inspection (SOI) – the supervisory authority for consumer protection: www.soi.sk
These GTC are governed by the legal order of the Slovak Republic.
The Provider reserves the right to amend these General Terms and Conditions.
These GTC are valid as of 15 April 2026. The current version is always published at https://www.facinguncomfortable.com/terms-conditions.
